Backups

1. Introduction

This document outlines the default backup policy used for Zyphico clients. All clients must adhere to this policy to ensure proper backups are being performed.

2. Software

The following software and utilities may be installed within their respective platform groups.

3. Software Specific Policies

3.1. Borgbackup

Borgmatic is started every 4 hours based on the local system time. The following retention policy is as follows:

  • 12 hourly archives
  • 7 daily archives
  • 4 weekly archives

Borgmatic will automatically prune archives as they age.

3.2 Other

All other software not defined in this document do not have a set policy and will be evaulated on a case by case basis.

4. Disclaimer

While Zyphico is able to create and maintain a reliable backup solution, it is still highly recommended for the client to create and maintain their own hard copies of their application data. Zyphico may be requested to perform a system backup.

Standard Plan

1. Plan Description

Perfect for small businesses with less than 10 servers. This plan offers a comprehensive IT support package, which will handle the lifecycle of your hardware and software.

1.1. Plan Scope

Zyphico provides the following services under this plan:

  • Install and configure client infrastructure
  • Maintain managed systems, networks, and application configurations
  • Provide ongoing technical support and IT Consulting
  • Troubleshoot any issues arising during client operations

By choosing this plan, you agree to the following fees:

2.2. Fee Descriptions

  • Service Setup - A one-time fee for setting up services.
  • Managed Services - This fee covers the following tasks:
    • Basic System Diagnostics, Under 1 Hour
    • Backup/Restoration
    • Data copy/transfer
    • System Updates
    • System Compliance
    • System/Network Monitoring
    • Technical Support
  • Service Rate - All work not covered by Managed Services is to be invoiced hourly under Service Rate.
  • Emergency Rate - Same as Service Rate, however is billed for work outside of operation hours.

3. Service Operations

Zyphico provides consultation, scheduling, and technical support between the hours of 11AM EST to 6PM EST, Monday through Friday. Business time will be conducted in “Eastern Standard Time (EST/UTC-5)” and/or “Univeral Coordinated Time (UTC)” zones.

Physical or remote access to the system is required for Zyphico to perform tasks and duties successfully. Zyphico may request access to external services the client uses in order to fulfill a task.

3.1. Response Time

Service response rates for this plan should expect to be 1-3 hours during operation hours on a best-effort basis. If contacted outside of operation hours, a response may be delayed until the next business day.

Changes affecting operation hours may occur, which includes US Holidays, posted days of absence, or unplanned emergencies. All planned abcenses will be posted in advance. You may schedule a timeframe outside of operation hours if given prior notice 48 hours before, and may incur an additional fee.

4. Service Termination

Should termination happen for any purpose and/or reason, the following steps will be performed:

  • The client will be notified of termination and any undue invoice balances.
  • Billing for service will be suspended immediately.
  • All affected systems will have any management/monitoring program removed.
  • Current system login credentials will remain in place.

Upon termination, you will be solely responsible for your infrastructure maintenance.

*A “Device” refers to a system managed by Zyphico, which will include the following: Workstations, Servers, Routers, Switches

TCPShield DDoS Protection

1. Description

TCPShield has been providing DDoS protection services for since 2015. Trusted over the years by many minecraft networks, they offer the ideal solution to protecting your infrastructure.

1.1 Features

The following features are provided by this plan:

  • 1 Network
  • Unlimited Bandwidth
  • Unlimited Domains
  • Minecraft Bedrock support

1.2 Limitation

This is considered an addon to Zyphico’s main service plans, and is subject to availability and termination of those plans.

This service is subject to Zyphico’s Terms and Conditions. Upon termination, the service provided will cease to work and be deleted.

6. Additional Terms

By using this service, you also agree to TCPShield’s Terms of Service at https://tcpshield.com/terms.pdf. TCPShield’s terms do not supercede Zyphico’s terms and conditions. This link may be subject to change, and is outside the control of Zyphico. Failure to adhere to Zyphico’s and/or TCPShield’s terms will result in termination of the service.

Terms and Conditions

These Terms and Conditions outline the rules and regulations for Zyphico’s Website and Services. By accessing this website, you accept these Terms and Conditions. Do not continue to use this website and/or services if you do not agree to all of the Terms and Conditions stated on this page.

This policy is effective starting November 14th, 2023. The latest update to this agreement was made on March 21st, 2024.

1. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New Hampshire, United States of America. You irrevocably consent to the exclusive jurisdiction and venue of the state or federal courts in New Hampshire for all disputes arising out of or relating to this agreement.

2. Billing

All invoices are due on the 1st of the month and must be paid before or on the due date. Service invoices will be sent ten days prior to the due date, which you will be notified of via email. Seven days following the due date of the invoice, Zyphico will suspend services for non-payment. After an additional seven days, your services will be terminated.

Zyphico, at its sole discretion and at any time, may modify service fees. Any changes will become effective at the end of the then-current billing period. Zyphico will provide you with reasonable prior notice of any changes.

2.1. Refunds

All payments to Zyphico are non-refundable. You acknowledge that all transactions are final upon purchase of services.

2.2. Late Fees

Any overdue or unpaid invoice balances will be subject to a late payment fee of $5 USD or 10%, whichever is greater, seven days after the due date has passed.

3. Acceptable Use Policy

3.1. Prohibited Conduct

You agree not to engage in any activity that may interfere with or disrupt Zyphico, including but not limited to hacking, scraping, or attempting to gain unauthorized access to our website or servers. You may not use our website and services for any illegal or unauthorized purpose.

3.2. Copyright Policy

If you are a copyright owner, or authorized on behalf of one, and you believe that copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through our services, you must submit your notice in writing to the attention of our copyright agent via email at [email protected] and include in your notice a detailed description of the alleged infringement.

4. Intellectual Property Rights

Zyphico, along with its licensors, holds the intellectual property rights for any materials used in the services provided, unless otherwise stated in writing. you may view/print public web pages and invoices for your own personal use subject to restrictions set in these Terms and Conditions. Any software licensed for Zyphico may not be transferable to you. It is forbidden to modify any program, script, configuration, or material provided by Zyphico without obtaining prior written consent.

5. Suspension and Termination

Access to services may be suspended or terminated immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms and Conditions.

All provisions of the Terms and Conditions should survive upon termination. This would include, without limitation, ownership provisions, and warranty disclaimers.

Upon termination, your right to use the services provided will immediately cease. If you wish to terminate your account, you may simply discontinue using the service.

Our website and services may contain links to third-party websites or services that are not owned or controlled by Zyphico. Zyphico has no control over, and has no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

7. Disclaimer

Services are provided “as is”, without warranty of any kind, express or implied. In no event shall Zyphico be liable for any claim, damages or other liability whether in an action of contract, tort or otherwise, arising from, out of or in connection with the service or the use or other dealings in the service.

8. Severability

In the event any provision or part of this Terms and Conditions is found to be invalid or unenforceable, only that particular provision or part so found, and not the entire Agreement, will be inoperative.

9. Policy Changes

Zyphico reserves the right to modify these Terms and Conditions. Changes are effective immediately upon posting on our website, and we encourage you to review our policy periodically.
